What is Eminent Domain & Condemnation

Just like taxation and zoning, Eminent Domain is the right of the government to seize or claim real property for public use, while Condemnation is the action to gain possession or title. Roads & Utilities are the most common application of Eminent Domain. Depending on the project, eminent domain can cause direct or indirect damage that you may be entitled to compensation.

Arkansas Law Concerning Compensation

In House Bill 1444, Arkansas Law states that property owners are entitled to fair compensation from entities claiming eminent domain over their property. A certified appraiser can help you determine the direct damage and indirect damage to your property. Indirect damage is commonly known as “damage to the remainder” and may often exceed that of direct damage.

Temporary Construction Easements

Commonly referred to “TCE”, are easements used for temporary projects that are compensatory. This type of easement is used in short term & long term construction projects that need access and storage areas near or in proximity to the site.
